Azken urte eta hilabeteetan, munduko (des)ordenamenduaren zangoz-goratze etengabean bizi gira eta zuzenbide estatua zalantzan jarria da alaire. Balia giten inpunitatearen inguruko gogoeta plazara eramateko. “Punitibismoaren” inguruko galderak ukatu gabe, estatuek eragin oinarrizko eskubideen aurkako erasoek galdezkatzen gaituzte. Hain zuzen ere, mendebaldeko demokrazietan torturaren iraupenak erakusten digu estatu demokratikoek gozatzen duten inpunitatea. Torturaren aurkako Nazioarteko konbenioaren (1987) arabera, tortura funtzionario baten eskutik eragin sufrikario fisiko edo psikologikoa da. Horregatik, Estatuko arma bezala aurkez daiteke torturaren praktika. Bestalde, estatuaren arma den heinean, torturak inpunitate sistema bat sortzen du bizirauteko. Torturaren sistema aztertzeko, beste hainbaten artean, Euskal Herriaren kasua aztergai ukanen dugu Espainiako gerlatik (1936) gaurregun arte (2022). Erregimen autoritariotik demokratikora ikertuko dugu nola 5.000 tortura kasu baino gehiago argitara eman diren Euskal Herrian kontestu politiko ezberdinenetan.
